General Terms & Conditions 

This contract is made and accepted under the following general conditions, which the parties undertake to fulfil each in its own right. 

OBLIGATION OF THE LESSEE  

The present contract is consented and accepted under the following general terms and conditions that the LESSEE agrees to: 

  • To live in the rented premises in a dignified manner, to maintain said premises, in particular the sanitary and electrical installations; if they deteriorate as a result of negligence or misuse during the rental period; to take responsibility for any repairs for which the renter may be held liable, 
  • To enjoy the rented premises as a good family father and to return them at the end of the stay in the same conditions as when the keys were handed over and IN A CLEAN STATE. 

IT IS STRICTLY PROHIBITED TO SMOKE INSIDE THE HOUSE.  

  • To take out the trash, empty the ashtray on a daily basis and to throw the ashes in the trash bin at disposal outside. It is permitted to smoke on the patio in the back, where a specific place was designed for it.    

In the event that the villa is unfit for rental due to the smell of cold tobacco (walls, windows, curtains, bedding, carpets, pillows, towels, sunbathing mattresses, other fabrics, etc.), the RENTER will be invoiced a fee which amount will be at least 50% of the total price of the stay.  

  • Not to place any object on the windowsills or wooden railings of the pavilion that could be detrimental to the cleanliness or appearance of the house, nor to hang laundry or anything else on them. 
  • To spread a dry bathing towel on the mattresses when under the sun, on the armchairs or sofas before laying or sitting on them before lying down or sitting down with sunscreen on or after getting out of the pool. If, at the end of the lease, it is found that the external furniture is stained or soaked, even partially, the LESSEE will be charged for cleaning or replacing the covers.  
  • To clean and cover up the barbecue after each use. 
  • Not to modify the premises in any way, nor the layout of the furniture inside or outside, nor any connection of any kind whatsoever and in particular to the television, hifi.... 
  • Not to cause a disturbance to the neighbors (noise, smells, smoke, lights, etc…) 
  • To authorise the RENTER to make any repair for which the urgency and necessity justify its handling during the period of the lease, without pretending to an indemnity or a reduction in rent.
  • To let the following service providers intervene: 
    • The swimming pool operator(s) on Wednesdays and Saturday mornings around 10am 
    • The gardener(s) on Mondays, Wednesdays and Friday afternoon 
    • The technicians of the pest control company (one intervention per month) 
  • The RENTER or its agent for the regular maintenance and maintenance operations to let visit the rented premises, for the whole duration of the present lease, whether in prevision of the selling or another lease. 
  • The LESSEE is not allowed to make any change in the overall layout of the premises nor transform them. 
  • Animals are prohibited inside he rented premises 
  • The premises are rented with furniture, cooking equipment, etc… For a given number of people that matches the maximum capacity of beddings which is 8 people, according to the inventory that the LESSEE must check and sign within 24h from his arrival. An ENTRY STATEMENT will be drawn up and signed on arrival by the LESSEE. 

All of the premises’ facilities are in working order and any reclamation regarding them that would happen more than 24 hours after the LESSSEE’s taking of the premises will not be accepted. Eventual repairs due to neglect or bad maintenance during the lease will be at the expense of the RENTER.  

The keys must be handed over when the LESSSEE leaves. 

The total number of keys handed to the LESSEE on arrival is two (2). As the loss of one or both keys would automatically lead to a change every lock of the house, the LESSEE would be financially responsible for the intervention. No key shall be copied without previous agreement from the RENTER. 

Upon the end of the lease, the LESSEE will return both keys (2) of the premises to the RENTER. 

Openings (French windows and standard windows) shall be protected at all time, from species that can potentially damage the property, through the constant use of mosquito screens. If at the time of the inventory of fixtures at the end of the lease, a proliferation of pests is noted, the total curative treatment of the villa will be invoiced to the LESSEE at the price of 13.00 € (thirteen euros) per m². 

  • The LESSEE recognized having been noticed by the LESSOR that: 
    • The swimming pool is only 1.80m deep at its deepest point and as such, he acknowledges being informed (himself and his family) of the risks of diving in a low-depth pool. He also recognizes that the latter is not equipped with any surveillance system. 
  • The LESSEE commits to immediately warn the LESSOR or his agent should the water level of the pool was to be lower than the skimmers levels in order not to deteriorate the swimming pool’s pump. 
  • Two safety boxes are at the LESSEE’S disposal. The LESSEE recognized having been informed that they do not offer any serious protection against theft. The code/key will be given upon arrival. 
  • A CCTV system covers the outside perimeter of the villa. Its control screen is placed inside the Master bedroom “LOVE OVER GOLD”. 
  • The villa is equipped with an anti-intrusion alarm box. Volumetric sensors are installed inside the bedrooms and the living room. The control keyboard is located next to the entrance. The siren is on the patio next to the pool. An automatic gate closes the access to the residence and is opened by the agents of the control post who filter visitors and ensure a 24/7 rounds of surveillance. 

Check-in and check-out hours of the LESSEE are to be determined in advance according to the hours of arrival and departure of the air connections.

Usage  

The LESSOR shall use the leased property and its furniture peacefully in accordance with the purpose set out above. He undertakes not to modify this purpose. 

He also undertakes to comply with any regulations that may apply to the leased property in such a way that the LESSOR can neither be worried nor sought after in this respect. 

Assignment - Sub-letting  

The LESSEE shall occupy the accommodation by himself, his family and the persons for whom he is responsible. Consequently, he may not transfer the rights he holds under the present lease, nor sublet, nor even lend, all or part of the rented property. 

It is expressly agreed between the undersigned that the present rental is for the number of persons declared in the contract (with a maximum capacity of eight (8) occupants). 

In the event that the number of persons declared in the contract is not respected, a lump sum of €1500.00 (one thousand five hundred euros) will be charged, which will be retained from the deposit. 

Responsibility – Insurance  

The LESSOR declares that he has insured his property and furniture against fire incidents. The LESSEE shall, if he/she deems it necessary, insure his/her personal effects and objects against fire and theft, the LESSOR declining all responsibility in this respect. 

The LESSEE must take out an insurance policy to cover the rental risks during his stay (fire, water damage, theft). Failure to take out insurance in the event of a claim will give rise to damages and interest. The LESSEE must provide proof of this insurance when the keys are handed over. 

The LESSEE shall be liable for any damage and loss that may occur during the term of the contract in the premises and the furniture of which he has exclusive enjoyment, unless it is proven that they have occurred by force majeure, by the fault of the LESSOR or by the act of a third party that he has not introduced into the accommodation. 

The LESSEE shall be solely responsible for any damage caused to the premises, the furniture, the occupants and other persons in the dwelling whether it occurs by himself, by persons for whom he is responsible or by animals and/or objects in his custody. 

The LESSEE shall be held responsible in case of theft of the pool furniture. The LESSEE shall take all necessary precautions to prevent the risk of theft, in particular to store the cushions in the dedicated cupboard each time he is absent, as well as in case of heavy rain.   

OBLIGATION OF THE LESSOR 

For his part, the LESSOR shall be obliged to maintain the leased property in a state of service for the use provided for in the contract and to make all repairs, other than rental repairs, necessary for the maintenance and normal upkeep of the leased property. 

To this end, the LESSEE undertakes to immediately inform the LESSOR of any deterioration that he notices and that would require repairs to be paid by the LESSOR.

The LESSOR is obliged to deliver to the LESSEE the dwelling and its furnishings in a good state of use and repair and the equipment mentioned in the lease agreement in good working order. The parties shall draw up an inventory of fixtures jointly when the keys are handed over to the LESSEE. A copy of the inventory of fixtures shall be given to each party. 

Another inventory of fixtures shall be drawn up, jointly and severally, at the end of the lease, when the keys are returned.

RENT AND ADDITIONAL SERVICES  

The amount of the rent includes an 8-people accommodation declared to the redaction of the present contract, within its time frame, which is to be determined before arrival of the LESSEE.

No additional persons may be accommodated without prior agreement with the owner. In the event of non-compliance with this clause, a penalty of €1500 (one thousand five hundred euros) will be withheld from the deposit.   

NO PETS will be hosted or kept during the stay. 

The LESSEE must take into account a departure cleaning fee of €155.00 (one hundred fifty five euros) to be paid before the payment of the final rental amount. 

Recoverable charges: Electricity: 6 baths per unit (approx. 16 Euro cents at the daily rate), Water: 32 baths per unit (approx. 86 Euro cents at the daily rate). The meters will be read on arrival and departure. 

The deposit 1500 € (one thousand five hundred euros) shall be paid by the LESSOR to the LESSEE at the time of payment of the balance of the rental 30 days before the arrival date (D-30). 

30% of the total amount of the rental is to be downplayed through bank transfer from the LESSEE to the LESSOR at the time of the reservation. 

50% of the amount of the rental is to be paid through bank transfer by the LESSEE to the LESSOR at the latest 60 days before the date of entry into the premises (D-60).  

The balance of the rent, i.e. 20% plus all additional services, must be paid to the LESSOR by bank transfer 30 days before the arrival date (D-30).  

No handover of keys will be done without payment of the balance on arrival  

The LESSOR can provide a number of services such as cleaning hours during the during the stay, breakfast, traditional meal services, Thai cooking classes, baby-sitting, filling of the fridge upon arrival, airport shuttle, driver, massage… (please check the available services with us) 

Extra payment for additional services is to be paid 30 days before arrival on the premises (j-30), no delay in payment shall be accepted. If this clause is not respected, the LESSOR reserves the right not to and over the keys. 

Whatever may happen: illness, accident or unforeseen event, the price must be paid in full under the above conditions. 

The LESSOR shall take the initiative of subscribing to a Cancellation-Seasonal Rental insurance policy, which will allow him not to have to pay the said rental under the conditions listed above.

PENAL CLAUSE  

It is agreed that in case of withdrawal of the LESSOR:  

  • less than 60 days before the effective date of the lease, the LESSEE shall pay in addition the difference between the deposits and the equivalent of the total rent as a penalty clause. 
  • more than 60 days before the effective date of the lease, the LESSOR will be reimbursed for the deposits paid, less an administrative reservation fee of 20% of the total amount of the stay. 
  • In the event of COVID confinement imposed by ministerial decree in the LESSOR's country or in the LESSOR's country, the sum paid at the time of the declaration of confinement shall be allocated to the benefit of a stay to be organised in year N or N+1 according to planning and availability. 

In the case of an exceptional refund, the LESSOR will retain a cancellation fee of 30%. 

If a delay of more than 24 hours in relation to the planned date of arrival happens and has not been notified by the LESSEE, the LESSOR shall be entitled to try to re-let the accommodation while retaining the right to take action against the LESSEE. 

WARANTEE DEPOSIT   

The LESSEE is to downpay to the LESSOR an amount of €1500 (one thousand and five hundred euros) by bank transfer as a warrantee deposit in order to answer for any loss, theft or damage that may be caused to the property or to the furniture or objects in the rented accommodation. The aforementioned deposit shall not be considered as a contribution to the payment of the stay. 

This deposit will be returned to the LESSEE after the expiry of the lease if no damage is found.  

Otherwise will be retained: 

  • The total value of the replacement price of broken, cracked, chipped, stolen or damaged furniture and equipment and those whose use would exceed the normal for the rental period. 
  • The cost of cleaning blankets, carpets, curtains, bedding, etc. which have been soiled or impregnated with the smell of tobacco. An indemnity for any damage to bedding, paint, woodwork, ceilings, carpets, windows, etc. 

What remains of the sum wired as a deposit will be returned to the LESSOR. 

Will also be retained: 

  • A €1500 (one thousand five hundred euros) fee in case of observation of a non-respect of the amount of people hosted and declared within the present contract. 
  • A penalty for any late payment of the renting amount. 

Reminder:  

An inventory of fixtures and an inventory shall be given to the LESSEE upon his arrival and shall be returned to the LESSOR signed within 24 hours. 

Otherwise, all deteriorations and differences noted in the inventory and not reported by the LESSEE shall be the responsibility of the LESSOR. 

CANCELLATION CLAUSE 

In the event of non-payment on the due dates or in the event of non-performance of one of the clauses of the present contract, the present contract shall be immediately terminated at the LESSOR's discretion and without judicial formality.  

ELECTION OF RESIDENCE 

For the execution of the present contract and its consequences, the parties elect domicile in their respective domiciles or registered offices. 

In the event of a dispute, only the local court of the judicial district where the rented property is located shall have jurisdiction. 

This agreement shall be subject to the exclusive jurisdiction of the Courts of THAILAND. These terms and conditions have 6 pages and 2 copies, one for the LESSEE, one for the LESSOR. A copy in English language will be attached. 

All parties have read and understood the objectives and intent of this agreement. 

All parties agree to initial and sign the agreement without erasure or overwriting and, in so doing, agree to all the terms and conditions contained herein.   

THE RENTAL WILL BE TAKEN INTO ACCOUNT AFTER RECEPTION OF THE DEPOSIT AND THE SIGNED CONTRACT WITHIN 72 HOURS. AFTER THIS TIME THE STATUS OF THE VILLA WILL BE PUT BACK AS AVAILABLE FOR RENT, except with the prior written agreement of the LESSOR.
